TERMS AND CONDITIONSRaynne Penconek, artist, will be creating digital art for the client (you). The art is a character(s) illustration. As the client, you are aware that Raynne Penconek will be creating a digital illustration for you. There will be NO physical copy sent. The digital illustrations will be sent in .png format unless otherwise requested.You agree that you MUST NOT use the commissioned digital art piece for use in AI generative images or NFTs. You WILL NOT be permitted to commission the artist if your intent is to use the art for AI or NFT purposes. Raynne Penconek reserves the right to withdraw from the client agreement if he is lead to believe that your intent is to use the art he creates for you for AI or NFT purposes. If you intend to use the commissioned art for AI generative images and NFTs, and if you have already processed the payment, you ARE NOT eligible for a refund.Upon commissioning, you agree to receive progress updates from Raynne Penconek about your commissioned art. If Raynne Penconek fails to send progress updates, you must reach out to him and ask to see progress updates. Harassment of the artist is prohibited.You agree to receive a PayPal invoice or e-transfer request BEFORE Raynne Penconek commences work on the commissioned art piece. However, if an agreement between you (client) and Raynne Penconek (artist) is reached about the payment timeline, for example, you say that you can pay half upfront and half afterward, and Raynne Penconek accepts, this does not apply. You MUST follow through with the agreement.Refunds are only permitted in the event of Raynne Penconek not being able to complete your commission by any means (and you DO NOT intend to use the commissioned art for AI generative images or NFTs). Under the circumstance that Raynne Penconek cannot finish the piece by any means, you will be fully refunded. However, if Raynne Penconek has already started illustrating your commission and has been in communication with the client, and YOU, the client, wish to withdraw from the transaction BEFORE the art is completed, you will be refunded 50% of what you originally paid. You agree that if you withdraw before the art is completed, you WILL NOT receive a finished art piece. You will only receive what has been completed before the withdrawal. If you request a refund AFTER the commissioned art is complete, you WILL NOT receive a refund.You agree that you MUST NOT advertise the art as your own creation. You reserve the right to your own character, and you are permitted to share the art piece online. However, you MUST credit the artist, Raynne Penconek, as the illustrator. You are not permitted to use the commissioned art piece for commercial purposes UNLESS an agreement with the artist was reached BEFORE completion of the art piece. You agree that you WILL NOT edit the art piece (i.e., removing the artist’s watermark/signature, drawing on top of the image, editing proportions) after receiving the finished file (cropping the image file is permitted).If you fail to comply with the terms and conditions listed above, Raynne Penconek reserves the right to stop communication and any work completed prior immediately. If you have already received the art piece and fail to comply with the terms and conditions, Raynne Penconek reserves the right to request that you delete the image file sent to you. You will not be permitted to commission the artist again.Before you contact the artist, you MUST agree to the terms and conditions contained herein.
